Subject: Sharp Vacuum, Model EC-S5170

On January 18, 2010, your salesman Bill Wojerski called on us to demonstrate a Filter Queen system. We felt the product was good, though expensive. We did decide to take the product, though we were unable to get financing of $2100.00. Your salesman made us another offer of $1500.00 for the product @ $45.00 month, with the first payment being February 18, 2010. There is no finance contract.

That night Bill Wojerski took our older, but in good condition Sharp model EC-S5170 with him as a trade-in, and left the Filter Queen equipment.

The next day, January 19, 2010, my wife and I decide that it was too expensive and we could not afford it. She called and canceled the order for the Filter Queen. You then made us another offer of $1100.00 @ 9.9% interest for 48 months @ $27.00. None of this is in writing.

On January 21, 2010, she called you and told you we did not want the Filter Queen because we felt we could not afford it, you then offered just the Defender for $16.00 per month. We refused that also. You asked her if we could return the Filter Queen and pick up our old vacuum [Sharp Model EC-S5170] we agreed to that.

A friend of ours and I brought the Filter Queen back that same morning, expecting to get back the vacuum your salesman took with him. You gave me a Sharp EC-S2365, in very poor condition which is similar to the one your salesman took. I insisted that all I wanted our vacuum back, not the older one you said was ours, and of course an argument ensued. The level was raised when you accused me of trying to scam you for a new vacuum cleaner. That was disrespectful and rude! All I ever asked for was the vacuum your salesman took with him from my house and nothing more. You do owe me an apology for that totally uncalled for remark.

Apparently you have no control of what your sales people and employees do, or how well they care for property that is not theirs. If it has been mislaid, misplace, or has been miss appropriated in some other way, then you need to know that. The vacuum I believe was/is mine until after the time midnight, January 21, 2010. I had to cancel the contract.

According to your contract; “If you cancel, any property traded in, any payments made by you under the contract or sale, and any negotiable instrument or other evidence of indebtedness executed by you will be returned in 10 days following cancellation, and any security interest arising out of the transaction will be cancelled.”

So given that and as we canceled and returned the product on January 21, 2010, you have until midnight, January 31, 2010 to return our vacuum, Sharp Model EC-S5170.
